Help Acquiring Fiancé(e) Visas in Wakefield

Our Goal Is to Make Your Dream a Reality

When a U.S. citizen wishes to bring a foreign national fiancé or fiancée to the United States to marry, a fiancé(e) visa petition needs to be filed with USCIS. Our Wakefield immigration attorney can assist you and your family. Our legal team understands how important this decision is and we know the particular criteria to follow them to increase your chances of a successful case.

To petition for a fiancé(e) visa, the following criteria must be met:

  • The petitioner is a U.S. citizen
  • The parties intend to marry within 90 days of the fiancé(e) entering the United States
  • Both parties are free to marry and any previous marriages must have been legally terminated by divorce, death, or annulment
  • Both parties have met each other, in person, at least once within two years of filing your petition

If the requirement to meet would violate strict and long-established customs of your or your fiancé(e)’s culture or social practice, or if you prove that the requirement to meet would result in extreme hardship to you, then you may be able to request a waiver.

Completing Your Petition

The completion of the petition is the first step to obtain a fiancé(e) visa. Once issued, the visa (or K-1 nonimmigrant visa) allows your fiancé or fiancée to enter the United States for 90 days so that your marriage ceremony can take place. Once you marry, your spouse may apply for permanent residence and remain in the United States while USCIS processes the application.
